Who Needs a Power of Attorney?

Everyone — including married couples. A power of attorney lets a trusted agent handle your financial affairs when you can't, and keeps your family out of guardianship court.

Who Needs One

Everybody needs a power of attorney — including married couples.

Many married couples assume they have automatic power to handle financial transactions on behalf of their spouse. That is not the case in Phoenix or any other state. A power of attorney appoints an agent to handle your financial affairs when you are unable to.

For example, your spouse could handle a joint bank account because they are jointly on it. But there are assets that a spouse cannot handle alone — specifically a home. Even if both spouses are on the title, they cannot sell the home without a power of attorney stating that the spouse can sell it.

The same is true for assets like retirement accounts and life insurance — a spouse cannot manage these on the other's behalf without this document. Without one in place, the family is forced to file for guardianship — an expensive, time-consuming process you don't want to face during an already emotional situation.

What It Covers

What a Power of Attorney can do for your family.

Sell Real Estate

Even if both spouses are on the title, neither can sell the home alone without a power of attorney granting that authority.

Manage Financial Accounts

Retirement accounts, brokerage accounts, life insurance — your agent can step in and manage them when you can't.

Handle Day-to-Day Affairs

Pay bills, file taxes, deal with insurance companies — the practical things that pile up if you're suddenly incapacitated.

The Alternative Is Painful

Without a POA, your family ends up in guardianship court.

Expensive

Guardianship requires court filings, attorneys, and ongoing reporting. The bills add up fast.

Time-Consuming

Guardianship petitions can take months to resolve — time your family doesn't have when bills need paying.

Emotionally Draining

Going to court while a loved one is incapacitated is the last thing any family wants to do.

Easily Avoided

A power of attorney prepared in advance saves your family from all of this. It's one of the simplest, most powerful documents we draft.
