Should I jointly title everything with my child to avoid probate?

It feels like a shortcut — and it's one of the most common (and costly) estate planning mistakes we see in Arizona.

The Short Answer

I highly suggest people do not use this approach.

Yes, jointly titling assets with a child does avoid probate — because once you pass away, the child legally owns the account or home. That part is true. But the trade-offs are usually much bigger than the convenience.

Once your child is a joint owner, that asset is also theirs. If they are sued, the creditor will see that home, bank account, or investment account as their asset. You can't simply explain it away by saying 'that's really mine, their name is just on it.' At that point, the creditor doesn't care. There are far better ways to avoid probate without giving up control or exposing your assets.

There's another problem people overlook. When a parent puts a child on an account or deed for convenience, it's usually just one child — even though they have several. The assumption is that the named child will 'do the right thing' and share with their siblings. Legally, they don't have to. If the parent passes and only one child's name is on the home, that child doesn't have to share the proceeds — and the other children have no legal recourse.

The Real Risks

What can go wrong when you add a child to title.

These aren't hypothetical. They're the patterns we see in probate and litigation.

Their creditors become your problem.

Once your child is on title, lawsuits, judgments, divorces, or bankruptcies they face can attach to your home or account.

You lose unilateral control.

Selling, refinancing, or closing the account may now require your child's signature — and their cooperation.

Other children can be unintentionally disinherited.

The child whose name is on the deed or account legally owns it at your death — siblings have no enforceable claim.

Family conflict and litigation.

Even well-meaning siblings end up at odds when one of them ends up holding 100% of an asset Mom or Dad 'meant to share.'

Possible gift tax consequences.

Adding a child to certain assets can be treated as a gift, with reporting requirements and long-term tax implications.

Loss of step-up in basis.

Joint titling can reduce the capital gains 'step-up' your child would have received by inheriting the property at your death.
