Parental Power of Attorney

Give a trusted adult — a grandparent, aunt, or uncle — temporary authority to care for your child while you're away, ill, or hospitalized. No court order, no transfer of custody.

What It Is

Temporary parental authority — without giving up custody.

A Power of Attorney is a legal document that gives another adult the authority to act on your behalf. The Parental Power of Attorney is used by parents and guardians to give another person temporary authority over their child. It's sometimes called a Delegation of Parental Powers.

The person you give authority to should be willing to accept temporary authority over your child — often a grandparent, aunt, or uncle. Choose someone you trust. There is no court order or transfer of custodial rights. Legal custody remains with you.

When You Need One

Important Limits

What a Parental POA can't do.

No Marriage or Adoption Consent

Under Arizona law, you cannot delegate the power to consent to your child's marriage or adoption.

No Custody Transfer

A Parental POA is temporary only. Legal custody stays with you and can only be transferred by court order.

Who Qualifies & How Long

Sound Mind, Adult, Arizona

Any parent or guardian who is over 18, lives in Arizona, and is of sound mind can delegate parental responsibility.

Up to Six Months

A Parental POA must end no more than six months after the start date. Military personnel can delegate for up to one year.

Valid in Arizona Only

Other states have different rules. If you're traveling, check that the POA will be honored where you're going.
